Sales Tax on digital images (versus physical deliverables)?18129

Recently had a scare from someone who said they thought real estate photographers paid sales tax.

It has been my experience in the state of Minnesota that we don’t pay sales tax unless images are either delivered in a physical capacity OR licensed for use in a physical capacity.

As we only license our images for electronic use, I think we’re still good. Anyone with more experience on this?

I'm a CPA (in a different state). Did some research, I think you're spot on. Seems like MN is very clear that the sales tax only applies if you're delivering a physical product, not performing a photography service with electronic delivery.

Of course, always worth it to reach out to a professional in your area so you can walk them through your entire workflow and delivery and get their interpretation.
