I have no problems with the terms themselves, the issue is that MLS does not allow outside links within tours. Thus this is a clear violation and will result in fines for every single agent that uses Matterport 3D Tours on MLS I personally have sent an email back letting them know I expect a full refund, and will be sending my camera back. |

Email receiver 03:57 from Scott; Hi there Gary, Apologies for the delay on this response! For the terms link, we need to have that, but we're going to be removing the "Buy" button and simplifying the overall page. I don't yet have a timeframe, but it's being actively worked on as we speak. -Scott |

I just sent this off to Scott and cc Paul at 10:15 GMT Hi Scott Thanks for getting back to me. I regard to the Terms of Use, this without a doubt applies to the individual who has generated the content and has nothing to do with those viewing the content. I can think of no cases where a viewer is subject to T&C’s, Facebook and Google Business View is prime examples of this. I can completely understand Matterport’s position on what is acceptable in regards to content being displayed in the Matterport Showcase. These Terms need to be accepted by the content provider via an email sent from Matterport to each individual who uploads content to Matterport. The Terms have no business being displays in or on the Producers final product pages i.e. Showcase. What you are saying is if a person coming to view content in a Showcase doesn’t review the terms of use then they are in violation of the terms. First this is a violation of certain European Laws as your would need to prevent the user from first viewing the content which you “have not and dare not” and secondly this content is the copyright property of the individual who has produced the content or in the case of Google Business View the business owner of the location shot I now request that Matterport remove the Term’s link for my content. Secondly I will be glad to sign an agreement in regards to the Terms of Content of what I upload to the Matterport Showcase. Best Regards Gary Snyder |

Perhaps an "accept" button the first time uploading to the Matterport Cloud or setting up Cloud account?

Just FYI Redfin gets their own special viewer that does not have the matterport at the bottom of the viewer. Powered by matterport in the upper right of the window but it would seem that removal of the matterport within the viewer is entirely possible for everyone but individual matterport owners like us. Also it seems to break when attempting to make it go full screen. Maybe just my machine... See it here. https://www.redfin.com/MN/Bloomington/3506-W-100th-St-55431/home/51389722 |

Hey Bryn... I just looked at the Redfin link, but they don't get a special viewer, at least not on that example. The "Terms" link is still present on the Showcase view as well. The only difference is the image that they (Redfin) created and used as the link to instigate the popup (w/Matterport branding)....and then there's a special wrapper on the popup that also has the additional matterport branding "Powered by Matterport". I'm sure they made some sort of deal on cameras/hosting/etc in exchange for all this additional branding. But, to be clear, the viewer looks the same, to me, as what we all have. |

I think what Bryn is referring to is the Matterport logo on the bottom center of the initial Showcase start-up screen which does not appear for Redfin. But there is plenty of other branding for Matterport. Don't forget that Greylock Partners are a main investor in Matterport as well as Redfin so that is why the Matterport branding is front and center. In our case it proves that the Matterport start-up logo can be easily removed from our showcases if Matterport so desired. |

Oh I see. Thank you for pointing that out. The matterport at the bottom is only on the iframe embed.... No I just checked this on some of my models. The matterport at the bottom is now gone!!!... Is everyone seeing this? Terms is still there yes. What is going on with this??? |

Wow...logo is gone. I didn't notice that earlier. I certainly can't speak for anyone but myself, but I'll happily take the missing logo with small upper "Terms" (which now links to a simplified Terms w/minimal formatting) over the alternative of the big Matterport logo at the bottom of every embed.

The terms are for us the producers of the content and as Dan had suggested earlier this morning if Matterport wants us to agree to the terms then post them every time we upload a job, not on the website where they have no business being.

Agreed if it stayed like this. We would be very very happy! Especially considering how much everyone has screamed about the branding. My guess is that it will revert though. They are probably working on it as we speak. Making changes to the viewer. The terms link is still a problem for our local MLS but if this is an intentional move its a very positive one that would go a long way to restoring some trust and good faith. Hopefully it stays this way but we will see. I really really hope it stays off. I want so badly to be a advocate of and for Matterport again and not have to be fighting back and forth. |

I recieved this response from matterport... Hello Brandon, Understood -- we're working on a fix where the TOS, if clicked, opens solely within the Showcase window, along with a button to close the TOS. So the user will never leave the Showcase, nor have any logo/branding/etc. -Scott |

Great news Brandon, but has anyone actually read these terms? This is the first paragraph from the terms. What do you all think? Please read these Terms of Service (“Terms”) carefully before using the Matterport website or any Matterport products, software, applications, data, imagery, models, functionality and/or services provided to you on, from, or through the Matterport website (collectively, the “Service”). Using the Service indicates that you accept these Terms and any policies and guidelines of Matterport incorporated herein by reference. If you do not accept these Terms or such policies or guidelines, you may not use the Service. |

I/we are in the same boat Brandon....ideally that would be gone too, but I don't think we'll see many folks clicking on that little link. As long as it is MLS compliant, I'm OK with it.

I hope so, if that is the case and they can keep the T&C in the showcase without branding and remove the Matterport start-up logo then I can also live with this.

I just opened one of my tours and clicked on the Terms link. It opens in a new tab, and still says "Matterport" right up at the top. I'm almost certain that this is going to expose my clients to MLS compliance issues. That means that inevitably, one of the other real estate photographers in town is going to call on it and I'm going to start losing clients. All Scott has done is tell us, "it has to be there." No explanation of *why* it has to be there. I would be very interested to hear their reasons. |

Hey Jon, They are working on a fix that will open a terms window or tab in the viewer with no branding on it. It will not link out and hopefully be compliant with ours and your MLS. Agreed not sure why it has to be on there are all but one thing at a time I guess.

I am just really keen to hear the "why" these must be here...especially with terms like this. All just seems a bit convoluted to me... 14. Children. The Service is intended for a general audience. Matterport does not seek through the Service to gather personal information from or about children under the age of 13. |

*BUMP* This issue hasn't been resolved, and we can't just let it lie. There's no reason for this stuff to be visible to the end user, or even our clients. The link needs to be removed from the tour, and we need to keep reminding Matterport that the people who pay their bills will not accept it. |
