Hi guys, I do not know if some of you remember my topic asking for an advice how to scan a big yacht. here is that topic https://www.wegetaroundnetwork.com/topic/12826/page/1/yacht-matterport-scanning--challenges/ the yacht was scanned and I provided the tour to the buyer 10 months ago. They were happy, even paid me some tip. However when I looked at the tour statistic I saw huge numbers in visits(1700 unique visitors) and impressions(6700) and they were all recent with about 25-70 unique visitors walking through my tour every day for the last 3 months. It has taken me a while to find where it's been posted online. However I have finally found where all views are coming from. It seems that some boat selling agent is using my tour on the boat manufacturer website at https://nordhavn.com/brokerage/listings/n86-arquimedes/ for his listing for this boat. I have sent an email to the person who has hired me asking if they have shared the tour with anyone online and waiting for their reply. Before I sent that email though I still did not know where my tour's shown online. I have sent an email to the agent asking where has he got the link for the tour from and reminded him it is a copyrighted media and he is using it illegally without our permission. I did not want to make the tour private because I was hopping to showcase it later on my website. So it was public since the date it was created on. What would you do apart from what I have done already in this situation? The boat has been relocated to USA and the Nordhavn website even has some pages dedicated to its arrival to Florida. |

Hi @Wingman, When someone uses my work without permission, I go one of two routes. If I was not paid for the work, then polite messages to the effect that I hope they remove the material before we go legal usually works. If I was paid in full then I take the view that time spent on this is costing me money, so I try to take a positive from the situation. In this case I would do a blog post illustrated with screenshots that demonstrate how successful the tour is. Oliver |

Do you have the original scan saved? Just duplicate it for your use. I would then take your original tour deactivate all scan points and add mattertage with your business info on intro redirecting link to a pay per view access link.

@ron0987 Do you have any "pay per view access link" demo? Would you please share them here? Thank you. |

If the unauthorized user gets nasty with you, just remember they have liability insurance which covers advertising acts. Their insurer will settle for a reasonable amount of anything under $25K without batting an eyelash. To back up my point, a Houston brokerage paid a multi-million dollar settlement for infringement: http://swamplot.com/bonus-copyright-lawsuits-mean-urban-living-could-have-another-thing-coming/2018-11-13/ More food for thought on stolen Real Estate intellectual property: https://www.har.com/blog_27879_houston--smarteplans-settles-copyright-infringement-lawsuit-with-sugar-land-luxury-property-realtor |

Thank you guys. The buyer has replied that they are not using the tour anymore & I can use it for my own needs. They have not said though if they have shared it with anyone. The agent has not replied yet. I will give them till Monday to reply and then disable public viewing or better protect it with password. I do not think I need to reprocess it as with the tour showing "oops, not available" or a password they should remove it from the listing soon. If not then I will reprocess and make a copy for my own use. Not sure I want to chaise them legally being in Australia but I am surprised they are still using it after my message. Here is that tour for WGAN members to see. I have promised to show it in my thread created before scanning. Ignore excessive scans, I have been just doing it for a buyer and they'd need smaller steps so they can inspect this yacht in great details |

@JuMP sorry I miss spoke, I have been looking for a good pay per view format. I have not used Matterport lately and confused it with the password protected link.

The tour has been put under password protection as it does not seem anybody at Nordhvn cares about somebody's else intellectual property. If I could I would put a message next to the password field that they are infringing copyright using it. if anybody from WGAN wants to see the tour DM me and I will give you the password. |

It seems my client has given it to them without contacting me so it is not the agent's fault. I have let them using it especially it is not going to be for a long time. The boat has been sold already.

@Wingman There is a share icon in the bottom right. In the future - where you do mot want the tour to show up elsewhere - you might consider disabling the share icon (in Matterport Workshop). Dan |

@Wingman I just viewed your your tour on the Nordhavn website for the vessel (wow what a nice boat), you might want to modify the title to include your business name then vessel info. It's yours.

Quote:Originally Posted by GETMYVR Thanks, there is my URL for "Presented By" already and I am sure out of 1700 unique viewers some of them could have tried to visit my website. The problem is the boat is in USA so it brings me very little value for USA viewers to come to my Australian website. Plus it is not going to be shown there for much longer. The boat has been sold according to the agent and the listing is going to be removed soon. BTW, that listing page cannot be found through Google. I was trying to google search where my tour was shown using the tour url when I saw tremendous amount of views and I found nothing. Then I started googling for the boat name and found YouTube video with a link to the listing. |
